WAIVER/RELEASE OF LIABILITY AND ASSUMPTION OF RISK


In consideration of participation in this programme by the Malaysian Nature Society Selangor Branch (MNSSB) and/or any other branches of the Malaysian Nature Society (MNS), I/on behalf of my family/children, the undersigned fully agree, understand and acknowledge the following:


1. That outdoor/indoor activities/games involve physical exertion and other risks, known and unknown and may result in injury. 


2. Is aware of the possibility of risk of injury, including but not limited to falling, tripping, snake bite, heat stroke, heart attack, hypothermia, insect bites & stings, poisonous plants, bodily injury, disease strains, fractures, eye injury or blindness, food poisoning, death or other ailments that cause serious disability.


3. Warrants and acknowledges that my and/or my family members including children's physical condition is excellent and my and/or my family including children's mental state is sufficiently stable to enable myself/my family including children to participate safely in indoor/outdoor activities and the associated activities.


4. Understand and agree that it is my and/or my family including children's responsibility to follow all safety rules and procedures explained.


5. Understand that any, or all belongings/possessions are left at the sole risk and responsibility of myself and/or my family including children's. The organisers and its staff/volunteers assume no responsibility for the loss or damage of belongings/possessions.


In consideration of taking part in the selected programme, the undersigned, on behalf of himself/herself, and/or behalf of his/her family including children, he/she/their successors or assigns, hereby releases and forever discharge the Malaysian Nature Society Selangor Branch (MNSSB) and/or any MNS branches, MNS, employees, volunteers, land owners, agents both jointly and severely, from any action, covenants, claims and demands for damages, cost, loss and injury, however arising, including negligence of the organiser which may have or may been sustained by the undersigned in any way relating to or arising out of participating in the programme or the equipment used including but not limited to the manufacture, selection, delivery, possession, use or operation of the equipment or the natural environment. The undersigned desires and agrees to assume any and all risks involved.


THIS DOCUMENT IS INTENDED TO BE A LEGALLY BINDING CONTRACT RELIEVING MALAYSIAN NATURE SOCIETY, MALAYSIAN NATURE SOCIETY SELANGOR BRANCH, ANY OTHER BRANCHES OF THE MALAYSIAN NATURE SOCIETY, THEIR EMPLOYEES AND VOLUNTEERS FROM LIABILITY FOR INJURY OR DEATH TO YOU AND/OR YOUR FAMILY MEMBERS INCLUDING CHILDREN. IF YOU HAVE ANY DOUBTS CONCERNING ANY ASPECT OF ITS CONTENTS, CONSULT AN ATTORNEY BEFORE SIGNING IT. THIS RELEASE OF LIABILITY AGREEMENT COVERS ALL INDOOR AND OUTDOOR ACTIVITIES OR EVENTS I OR/AND MY FAMILY MEMBERS INCLUDING CHILDREN PARTICIPATE HEREAFTER.
